SCOTUS Will Hear Case on ‘Gender-Affirming Care’ for Minors
The Hill reported that the Supreme Court will review the constitutionality of Tennessee’s law banning “gender-affirming care,” i.e. puberty blockers and transgender surgery, for minors. This follows the Biden administration’s request, citing the need to resolve conflicting lower court rulings that create uncertainty. Nearly half of U.S. states have enacted similar bans. Legal challenges have had mixed outcomes, and federal appeals courts are divided. The Justice Department argues the Supreme Court’s intervention is critical to prevent harm to affected families.

The Biden administration said the Supreme Court’s intervention was “urgently needed,” arguing that those conflicting court rulings have created “profound uncertainty” for transgender people.
“Absent this Court’s review, families in Tennessee and other States where laws like SB1 have taken effect will face the loss of essential medical care,” the Justice Department wrote in its petition to the high court.

"It's almost universal that parents have genuine love for their children far more than government loves their children. Tennessee simply recognizes this fact while the Biden administration, California, and a few other culturally motivated states feign their love for children while filling their pockets with cash from leftist organizations that seek to over-sexualize children," Robert Tyler, President and General Counsel of Advocates for Faith and Freedom, said in a statement to Fox News Digital.
Tyler is not involved in this specific litigation picked up by the Supreme Court, but Advocates for Faith and Freedom has made similar arguments challenging a law making California a "transgender sanctuary state."
"Why should we trust extremist politicians more than parents when it comes to the best interest of a child?" he told Fox News Digital Monday. "Parental rights are protected under the due process clause and are enshrined in our constitution under the Fourteenth Amendment. We must ensure parents continue to have a say in what happens to their children - particularly regarding their mental and physical health."
Oral arguments are expected later this year, with significant implications for similar laws nationwide.
