Not a Weiss Idea: Garland’s Appointment to Investigate Hunter Biden
Some guys have all the luck. Last week, The Post Millennial Attorney General Merrick Garland announced the surprise appointment of David Weiss, the U.S. Attorney for Delaware, as a special counsel to investigate Hunter Biden and the handling of allegations against him by the DOJ. Weiss, who has been scrutinized for his prior inaction, including alleged lack of proper investigation of Biden and his potential bias, requested the appointment. Garland said the special counsel will operate independently, adhering to DOJ regulations.
However, The Post Millennial also reported that Garland’s appointment violates federal regulations:
The Code of Federal Regulations section 600.3 reads, in part: "The Special Counsel shall be selected from outside the United States Government."
Weiss, a US attorney, was appointed as US Attorney for the District of Delaware by former President Trump, and was sworn in on February 22, 2018. Per Garland's Friday announcement, Weiss requested to be special counsel, and will retain his position as US Attorney to Delaware.
