Marine veteran Daniel Penny, 26, was acquitted by a Manhattan jury of criminally negligent homicide in the May 2023 death of Jordan Neely, a homeless man, whom Penny placed in a subway chokehold after he became aggressive toward other passengers. The New York Post reported the verdict has drawn polarized reactions. People on the Left, like NYC Comptroller Brad Lander and Council Member Lincoln Restler criticized the decision, labeling it a failure of the justice system and mental health policies. Zohran Mamdani, a NYC mayoral candidate, called for systemic reforms to address homelessness and mental health crises.
Those on the Right, including House Republican Chip Roy, praised the verdict as a step against perceived prosecutorial overreach, advocating federal review of the case.
Local support for Penny also emerged, with Long Island County Executive Bruce Blakeman hailing him as a hero. Vice President-elect JD Vance posted on X, “I have not said much about this case out of fear of (negatively) influencing the jury. But thank God justice was done in this case. It was a scandal Penny was ever prosecuted in the first place.”
Following the acquittal, he enjoyed a well-earned drink with his lawyers at Stone Street Tavern in New York.
