Courts Continue to Strike Down Biden’s Title IX Expansion to Include Gender
The Biden administration’s Title IX regulation to redefine “sex” to include gender identity, continues to face significant legal challenges. Just the News reported that judges in different federal appellate jurisdictions have blocked the regulation in ten states.
U.S. District Judges Terry Doughty and Danny Reeves issued rulings criticizing the regulation as “arbitrary and capricious” and a violation of First Amendment rights. In his ruling, Judge Reeves emphasized that Title IX was originally based on a fixed biological distinction between sexes and accused the administration of compelling speech by requiring the use of preferred pronouns. The new rule, requiring school employees to address off-campus conduct on social media, was also criticized in the ruling.
The regulation, set to take effect August 1, risks federal funding loss for non-compliant schools. Judge Doughty’s ruling protects Idaho, Louisiana, Mississippi, Montana, and several school boards. Both judges noted that the Supreme Court’s Bostock decision on gender identity in employment does not apply to Title IX.
