Are Biden’s Autopen Pardons Legal?

President Donald Trump declared that last-minute pardons issued by President Joe Biden were “void” because they were signed using an autopen rather than by Biden himself. Posting on Truth Social, Trump said Biden was unaware of the pardons and suggested criminal wrongdoing. He posted:

The “Pardons” that Sleepy Joe Biden gave to the Unselect Committee of Political Thugs, and many others, are hereby declared VOID, VACANT, AND OF NO FURTHER FORCE OR EFFECT, because of the fact that they were done by Autopen. In other words, Joe Biden did not sign them but, more importantly, he did not know anything about them! The necessary Pardoning Documents were not explained to, or approved by, Biden. He knew nothing about them, and the people that did may have committed a crime.

The New York Post noted that among those pardoned were members of the Jan. 6 House Select Committee, Dr. Anthony Fauci, and General Mark Milley. Trump called the move “disgraceful” and suggested investigations into those involved.

Last week, the New York Post reported:

The conservative Heritage Foundation’s Oversight Project uncovered the situation, prompting Biden detractors such as Republican Missouri Attorney General Andrew Bailey to suggest it could be used to challenge the legitimacy of orders that the 82-year-old former president signed, especially given the concerns about his cognition.

“I am demanding the DOJ investigate whether President Biden’s cognitive decline allowed unelected staff to push through radical policy without his knowing approval,” Bailey said.
